Terms and Conditions

Article 1 – Definitions

 

In these terms, the following definitions apply:

 

Cooling-off period: the period in which the consumer may exercise the right of withdrawal;

 

Consumer: the natural person not acting in the exercise of a profession or business who enters into a distance contract with the trader;

 

Day: calendar day;

 

Duration contract: a distance contract relating to a series of products or services, for which the delivery obligation is spread over time;

 

Durable data carrier: any tool that enables the consumer or trader to store information in a way that allows future access;

 

Right of withdrawal: the consumer’s option to withdraw from the distance contract within the cooling-off period;

 

Trader: the natural or legal person offering products and/or services to consumers at a distance;

 

Distance contract: a contract concluded between the trader and consumer within a system organised for distance selling of products;

 

Means of distance communication: any method that can be used to conclude a contract without the consumer and trader being in the same place at the same time.

Article 3 – Applicability

 

1. These terms apply to every offer by the trader and every distance contract between the trader and the consumer.

 

2. Before the distance contract is concluded, these terms are made available to the consumer.

 

3. If the contract is concluded electronically, the terms may be provided electronically in a way that allows easy storage.

 

4. If specific product or service terms apply, the most favourable provisions for the consumer prevail.

 

Article 4 – The Offer

 

1. If an offer has a limited validity or is subject to conditions, this will be stated.

 

2. The offer is non-binding; changes do not affect already concluded contracts.

 

3. The offer contains a complete and accurate description of products or services; images are truthful.

 

4. Obvious errors or mistakes are not binding.

 

5. The offer clearly states the price (incl. VAT), delivery costs, method of contracting, payment and delivery details, and any exceptions to the right of withdrawal.

 

Article 5 – The Contract

 

1. The contract is concluded when the consumer accepts the offer and meets the stated conditions.

 

2. When accepted electronically, the trader confirms receipt of acceptance electronically.

 

3. The trader takes appropriate technical and organisational measures to secure electronic communication.

 

4. The trader may—within legal limits—check whether the consumer can meet payment obligations.

 

5. Upon delivery, the consumer receives information on complaints handling, warranty, withdrawal rights, and cancellation conditions.

 

Article 6a – Right of Withdrawal for Products

 

1. The consumer may cancel the purchase within 14 days of receipt without stating reasons.

 

2. During this period, the consumer handles the product carefully and inspects it only as needed.

 

3. Withdrawal must be reported within 14 days by form or clear statement; after this, the consumer has 14 more days to return the product.

 

4. If the consumer does not withdraw or return the product on time, the purchase becomes final.

 

Article 6b – Right of Withdrawal for Services

 

1. For services, the consumer may withdraw within 14 days after entering into the contract.

 

2. Withdrawal follows the trader’s instructions.

 

Article 7 – Costs in Case of Withdrawal

 

1. Return shipping costs are borne by the consumer.

 

2. Refunds are issued within 14 days of withdrawal, using the original payment method.

 

3. If the product has been used beyond what is necessary, depreciation may be charged.

 

Article 8 – Exclusion of the Right of Withdrawal

 

1. Exclusions apply only if clearly stated in advance.

 

2. No withdrawal right exists for custom-made items, personalised goods, perishable products, unsealed audio/video, or hygiene-sensitive items.

 

3. No withdrawal right for services such as accommodation, transport, leisure activities on a set date, or services performed with consumer consent before the end of the cooling-off period.

 

Article 9 – Price

 

1. Prices include VAT and statutory charges.

 

2. Prices within the validity period of the offer will not be increased except due to VAT changes.

 

3. Price increases after 3 months apply only if legally required or agreed upon, with a right to cancellation.

 

4. Obvious printing or typing errors are not binding.

 

Article 10 – Conformity and Warranty

 

1. The trader guarantees that products meet the contract and reasonable standards of quality.

 

2. Defects must be reported within 4 weeks; products must be returned in original condition.

 

3. Warranty duration equals the manufacturer’s warranty unless stated otherwise.

 

4. Warranty lapses in cases of modification, misuse, or negligence.

 

Article 11 – Delivery and Execution

 

1. The trader handles orders with care.

 

2. Delivery takes place at the address provided by the consumer.

 

3. Orders are delivered within 30 days unless agreed otherwise.

 

4. In case of delay, the consumer may cancel and will be refunded within 14 days.

 

5. Risk transfers upon delivery to the consumer or designated third party.

 

Article 12 – Payment

 

1. The consumer pays through the offered payment methods within 14 days of ordering.

 

2. Orders are shipped after payment is received unless agreed otherwise.

 

3. If payment is not made on time, the trader may cancel the contract after notice.

 

Article 13 – Complaints Procedure

 

1. The trader has a complaints procedure and handles complaints accordingly.

 

2. Complaints must be submitted in time and clearly described (in writing or by email).

 

3. Complaints are answered within 14 days; if more time is needed, the consumer receives notice and a timeframe.

 

4. If justified, a suitable solution will be sought (replacement, repair, or compensation).

 

5. If not resolved, the complaint may be submitted to an independent dispute committee.

 

Article 14 – Disputes

 

1. Dutch law exclusively applies to all agreements.

 

2. For EU consumers, the ODR platform is available: ec.europa.eu/consumers/odr.

 

3. The choice of Dutch law does not exclude other legal protections where mandatory law applies.

 

Article 15 – Additional or Deviating Provisions

 

Additional or deviating provisions may not disadvantage the consumer and must be provided in writing or on a durable data carrier.
